Terms of Service

These terms are the agreement between you and Bay Pulse, a sole proprietorship, for use of Bay Pulse Studio. By creating an account you accept them. If you are agreeing for a company, you confirm you may bind it.
What the service is
Bay Pulse Studio builds, hosts, and publishes websites using an AI agent. You describe what you want; the agent writes the site; you can edit it, publish it to a domain, and take it with you.
Your account
- Give accurate details and keep your sign-in secure. You are responsible for what happens under your account.
- One account per person or business. Don't share credentials.
- You must be 18 or older.
Plans, billing, and cancellation
- Subscriptions are monthly and charged in advance through Stripe. Prices are shown before you pay.
- Each plan covers a number of sites and a monthly allowance of AI builds. Reaching a limit stops that action until you upgrade or the month resets; it never deletes anything.
- Cancel any time, from the billing portal. You keep access to the end of the period you have paid for. We do not pro-rate partial months.
- If a payment fails or you cancel, your published sites stay online for 14 days. After that the published site is taken offline, and your files remain available to export or to republish if you resubscribe.
- We may change prices with at least 30 days' notice by email. Continuing after that is acceptance.
Refunds
We would rather you were not stuck paying for something that is not working for you.
- Your first payment: if Bay Pulse Studio is not what you needed, tell us within 14 days and we will refund it in full, provided you have not published a site and have used no more than five AI builds. No argument required.
- Beyond that, subscription fees are non-refundable, though we look at every request on its merits — if something went genuinely wrong at our end, write to us and we will put it right.
- AI builds are not refundable, including when you do not like the result. Each one spends real compute the moment you ask for it, whether the outcome pleases you or not. This is why the first-payment window above is capped at five builds rather than being unconditional.
- Renewals are not refundable once the new period starts. Cancel before the renewal date to avoid the charge; the billing portal shows you when that is.
- None of this limits rights you have under law, including any statutory cancellation right where you live.
To ask for a refund, cancel your subscription first, then email [email protected] from your account address. Please contact us before disputing a charge with your bank — a chargeback locks the account and makes it slower to sort out, not faster.
Your content, and who owns what
- You own your content — your text, images, brand, and the sites produced for you. We claim no ownership of them.
- You grant us the licence needed to run the service: to store, process, and publish your content, and to send it to the AI providers listed in our Privacy Policy so the agent can do its work.
- You are responsible for having the right to everything you upload, and for your site complying with the law — including any privacy policy your own site needs.
- We own Bay Pulse Studio itself: the platform, the agent, and the starter templates. Sites the agent produces for you are yours.
Acceptable use
Do not use Bay Pulse Studio to build or host anything that:
- breaks the law or infringes someone else's rights;
- impersonates a real person or organisation, or defrauds people;
- distributes malware, phishing pages, or unlawful adult content;
- sends unsolicited bulk email, or attacks or overloads our systems or anyone else's;
- attempts to reach another customer's account or projects, or to circumvent plan limits.
We may suspend or remove content that breaches this, and will tell you why.
What the AI can and cannot be relied on for
The agent writes text, code, and images automatically. It can get things wrong: copy may be inaccurate, and generated content may resemble other work. Review your site before you publish it, particularly prices, claims about your business, and anything a customer might rely on. You are responsible for what your published site says.
Availability
We aim to keep Bay Pulse Studio running but do not promise a specific uptime. We may need to interrupt it for maintenance, and we may change or discontinue features. If we discontinue the service entirely we will give reasonable notice and time to export.
Ending the agreement
- You can close your account at any time.
- We may suspend or close an account for a breach of these terms, non-payment, or where the law requires it. Except in serious cases we will warn you first.
- On closure the grace period above applies, and you may export your sites.
Disclaimers and liability
Bay Pulse Studio is provided "as is", without warranties beyond those the law implies and does not allow us to exclude. To the fullest extent the law permits, Bay Pulse is not liable for indirect or consequential loss, lost profits, or lost data, and our total liability for any claim is limited to the amount you paid us in the 12 months before it arose. Nothing here excludes liability that cannot lawfully be excluded.
Indemnity
You agree to cover Bay Pulse against claims arising from your content, your published site, or your breach of these terms.
Governing law
These terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws rules. Disputes go to the state or federal courts located there, and we each consent to that.
Changes
We may update these terms; the date above shows when. Substantive changes are emailed to account holders. Continuing to use Bay Pulse Studio after a change means you accept it.
